Also keep in mind Terms of Service are subject to change  at any time for any reason deemed necessary and amendment will be  effective of the site and services once posted. Prices  and descriptions are subject to change without any notice and the site  information may not always be accurate and up to date. In event an order  is cancelled we will attempt to notify you. You may not attempt to gain  access of the site by any means or use services for illegal or unlawful  purposes. You may not use services for commercial purposes  what-so-ever. The website does not permit orders from wholesale dealers  or any customer for resale purposes. We may refuse to accept or may  cancel any transaction without any liability to you or a third party.  You shall immediately notify Forever Berkeley if you suspect or become aware  of any loss, theft, or unauthorized use of your password/information.

Limitation of Liability

All  content on website are provided “as is” and “as available”. Forever Berkeley does not warrant that (1) all information on the site is correct,  accurate or reliable (2) the functions on the site will be uninterrupted  or error free (3) defects will be corrected, or the server will be free  of viruses or harmful components. We shall not be liable for any  damages what-so-ever out of or relating to the use by any person of this  website. We make no warranty for any hardware or software damages  resulting from the use of this website by any person.

Governing Law

In  the event of litigation, both parties waive a trial by jury and agree  that the law of the state of business registration for Forever Berkeley shall  apply; both parties shall consent to then jurisdiction of said courts.

Electronic Signatures and Agreements

You  agree by clicking on the buttons labeled “SUBMIT”, “DOWNLOAD”, “PLACE  MY ORDER”, “I ACCEPT”, or any other link through which you will be  submitting billing or shipping information, or such similar links  designated by Forever Berkeley you are submitting and entering a legally  binding contract.
